Renting: what to know

Buying: Việt Kiều compared with foreigners

Foreigners

  • The Housing Law 2023 (in force 1 January 2025) lets foreigners who may enter Vietnam buy apartments or houses only in commercial housing projects outside defense and security areas. 8 9
  • Foreigners together may own no more than 30% of the apartments in one building, or 250 houses in an area the size of a ward. 8 Decree 95/2024 sets that area at 10,000 people, based on approved planning; this still stands after the February 2026 amendments. 10 11
  • A foreign individual owns for up to 50 years from the certificate date, extendable once by up to 50 years. If the home is not sold or given away before the term ends, it becomes state property. 8
  • A foreigner married to a Vietnamese citizen and living in Vietnam may own homes with the same rights as a Vietnamese citizen. 8
  • A foreign owner who rents out the home must tell the local housing agency in writing first and pay tax on the rent. 8

Overseas Vietnamese (Việt Kiều)

  • Overseas Vietnamese who still hold Vietnamese nationality have the same land rights as citizens living in Vietnam, under the Land Law 2024. 12
  • People of Vietnamese origin without Vietnamese nationality, if allowed to enter, may own a house together with the land-use right, and may buy residential land-use rights in housing projects; they can sell, give, leave as inheritance or mortgage them. 12
  • The Housing Law also lets overseas Vietnamese who may enter Vietnam own homes with land-use rights under the land law. 8

Rules on which projects are open to foreign buyers are published by each province. Use a licensed Vietnamese lawyer before paying any deposit.
